1. Agreement to Terms

By engaging CMD Tech for elevator, escalator, or travelator services, you agree to be bound by these Terms and Conditions. These terms apply to all services provided by CMD Tech, owned and operated by Craig Miller, located in Syracuse, New York.

2. Services Provided

CMD Tech provides the following services:

  • Maintenance and repair of elevators, escalators, and travelators
  • Installation and mounting of new systems
  • Emergency repair services
  • Safety inspections and compliance testing
  • System modernization and upgrades
  • Preventive maintenance programs

3. Service Terms

3.1 Emergency Services

Emergency services are available 24/7 at (406) 315-0901. Emergency service rates may apply for calls received outside normal business hours, weekends, and holidays.

3.2 Scheduled Services

Scheduled maintenance and non-emergency repairs are typically performed during normal business hours: Monday-Friday 8:00 AM - 6:00 PM, Saturday 9:00 AM - 4:00 PM.

3.3 Access Requirements

Client must provide safe and reasonable access to equipment for service performance. Any delays due to access issues may result in additional charges.

4. Payment Terms

4.1 Payment Due

Payment is due within 30 days of invoice date unless otherwise agreed in writing. Late payments may be subject to a 1.5% monthly service charge.

4.2 Emergency Services

Emergency services may require payment upon completion or advance payment depending on the situation.

4.3 Parts and Materials

All parts and materials are charged at cost plus applicable markup. Special order items may require advance payment or deposit.

5. Warranties

5.1 Service Warranty

CMD Tech warrants that all services will be performed in a workmanlike manner in accordance with industry standards. Any defects in workmanship will be corrected at no charge within 90 days of service completion.

5.2 Parts Warranty

New parts are warranted according to manufacturer specifications. Used or refurbished parts carry a 30-day warranty unless otherwise specified.

5.3 Warranty Limitations

Warranties do not cover damage caused by misuse, abuse, normal wear and tear, acts of nature, or modifications made by others.

6. Liability and Insurance

6.1 Insurance Coverage

CMD Tech maintains appropriate general liability and professional liability insurance coverage.

6.2 Limitation of Liability

CMD Tech's liability for any claim arising from services provided shall not exceed the amount paid for the specific service giving rise to the claim.

6.3 Safety Compliance

All work is performed in compliance with applicable safety codes and regulations. Client is responsible for ensuring ongoing compliance with local building codes and safety requirements.

7. Cancellation Policy

Scheduled service appointments may be cancelled with at least 24 hours notice. Same-day cancellations or no-shows may be subject to a service call charge. Emergency service calls cannot be cancelled once a technician is dispatched.

8. Force Majeure

CMD Tech shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or material shortages.

9. Governing Law

These terms and conditions shall be governed by the laws of the State of New York. Any disputes arising from these terms shall be resolved in the courts of Onondaga County, New York.

11. Modifications

CMD Tech reserves the right to modify these terms and conditions at any time. Clients will be notified of any material changes. Continued use of services after modification constitutes acceptance of the updated terms.
